 Kindly read the terms and conditions ("Terms and Conditions") set out below before ordering any Goods or Services from this Website. By ordering any Goods or Services from this Website, you agree to be bound by these Terms and Conditions.

Section 1: Introduction

This Website http://origine.ph is a proprietary platform of Origine, a brand of Easting Inc., locally operated by My Sommelier Inc of GF Jannov Plaza Bldg 3 Don Chino Roces Ext. Ave., Magallanes, Makati City, Philippines, under an exclusive franchise agreement between Easting Inc and My Sommelier Inc.

Section 2: Definitions

2.1. “Agreement” is a reference to these Terms and Conditions, any order and payment agreement provided between you and this website;

2.2. “you”, “your” and “yours” are references to you the person accessing this Website and ordering any Goods or Services from the Website;

2.3. “we”, “us”, “our”, “company” refers to My Sommelier, as operator of the Origine Web Store;

2.4. “Goods” refers to any goods which we may offer for sale from our Website from time to time;

2.5. “Service” or “Services” refers to any service which we may supply and which you may request via our Website;

2.7. “Website” is a reference to our Website http://origine.ph.

Section 3: Ordering

3.1. Any contract for the supply of Goods and Services from this Website is between you and My Sommelier, as operator of the Origine Website. You agree to take particular care when providing us with your details and warrant that these details are accurate and complete at the time you order. You also guarantee that the payment card details that you provide are for your own or you are authorized to use such legally, and that you have sufficient funds to make the payment.

3.2. Goods and Services purchased from this Website are intended for your use only and you warrant that any Goods purchased by you are not for resale and that you are acting as principal only and not as agent for another party when receiving these Goods and Services.

3.3. We shall take all reasonable care within our capacity to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Website.

3.4. Any order that you place with us is subject to product availability, delivery capacity and acceptance by us. When you place your order online, we will contact you via email and phone to confirm the order. You must advise us immediately if any details are incorrect. The fact that you receive an automatic e-mail confirmation does not necessarily mean that either we will be able to fill your order. Once we have sent the confirmation email we will check availability and delivery capacity.

3.5. The Website shall endeavor to publish Goods and Services available for delivery and servicing. Whether the ordered Goods and Services is available or unavailable, we will confirm with you and schedule delivery details.

Section 4: Prices and Payment

4.1. All prices listed on the Website are correct at the time of publication; however, we reserve the right to change these without due notice unless for confirmed orders between you and us. Prices are inclusive of the relevant sales tax, and itemized if there are delivery charges. We also reserve the right to change the Goods or Services published on the Website without prior notice, excluding any effect to your confirmed orders.

4.2. The total price for Goods or Services ordered, including delivery charges and other charges, will be shown to you on the Website when you place your order. Online full payment upon ordering must be made for all Goods and Services prior to delivery.

4.3. To ensure that payment online is secure, your card details will be encrypted to prevent the possibility of someone being able to read them as they are sent over the internet. Your card company may also conduct security checks to confirm it is you placing the order.

4.4. Payments are processed by Paynamics and existing under the laws of the Republic of the Philippines.

Section 5: Delivery and Returns

5.1. Delivery periods quoted at the time of ordering are our best estimates only and may vary, subject to prior notice to you. Our delivery schedule is every Saturday within Makati and Taguig as of the date of writing of this policy, subject to change with further advice to all concerned. Pick up of orders at our warehouse in GF Bldg 3 Jannov Plaza, 2295 Don Chino Roces Ext Ave, Magallanes, Makati City 1232 are also welcome with prior advice. Minimum order amount for waived delivery charges is Php 5,000.00 per one invoice or one order. Should any order is requested beyond these designated schedule, areas and order amount, you may contact our Customer Service Hotline and we will confirm these special considerations on a case to case basis. Any order online outside these designated schedule, areas and order amount, without directly contacting our Hotline shall not be confirmed.

5.2. Delivery can either be done by in-house employees of the Company and/or our accredited delivery service providers. Either way, the Company guarantees to deliver within our quality standards in a timely manner.

5.3. In case of late delivery, the delivery charge will neither be voided nor refunded by the Company.

5.4. All risk in the Goods shall pass to you upon your receiving of the delivery. You have to ensure that you have inspected the goods and agree to the state of the products upon delivery before signing the delivery receipt.

5.5. If you fail to accept delivery at the time and place agreed, or delivery failed at the agreed time due to wrong / inappropriate instructions, or unclear authorizations from you, then such goods shall be deemed to have been delivered to you and all risk and responsibility in relation to such Goods shall pass to you. Any storage, insurance and other costs which we incur as a result of the failed delivery shall be your responsibility and you shall indemnify us in full from such cost.

5.6. You must ensure that at the time of delivery, you are available and have arranged adequate arrangements, including access if necessary, are in place for the proper delivery of such goods. We cannot be held liable for any damage or cost incurred to such goods or premises if this arises as a result of a failure to provide adequate access or arrangements for delivery.

5.7. We only deliver to select areas as published in the Website.

5.8. Returns. After you have signed the delivery receipt, returns and quality issues for perishable goods should be reported to us within 24 hours upon your receiving of the goods.  For non-perishable goods, returns and quality issues should be reported to us within seven (7) days upon your receiving and sign off of the delivery receipt. Consideration for return and refund takes due process starting i) whether the abovementioned timeline has been complied, ii) state and condition of the goods at the time of your complaint e.g. whether it has been stored properly, it has been partially or fully consumed, cut, processed, among other alterations, iii) storage conditions for the products have been observed from the time you received the goods until your time of complaint and our pull out, and iv) exclusion of any probable instance that your complaint is due to change of preference or expectation over the product/s.

Section 6: Cancellation

6.1. You can cancel your order before clicking the button to Check Out, or After Check Out but before Payment. If you cancel your order after Payment, this is subject to the Company’s approval which will be communicated to you if the Goods and Services logistics (including shipping) and preparation have been already done wherein we can no longer cancel your order.

6.2. We may cancel a contract if the product is not available for any reason. We will notify you if this is the case and return any payment;

6.3. For any cancellation done and accepted by us After your online Payment was made, we will refund or re-credit it to your payment means or card with the agreed amount within 14 to 21 working days.

6.4. In the unlikely event that we deliver a wrong item, you have the right to reject and you shall be fully refunded or offered a replacement or re-delivery with the correct product. If we can only do partial delivery (due to different items’ availability), we will inform you or propose to replace missing items. You have the right to refuse our proposed replacements and get a refund.

Section 7: Information

7.1. You agree to provide us accurate and complete information for the purpose of your order, its delivery and payment.

7.2. You authorize us to use, store or otherwise process your personal information in order to serve your order.

7.3. You can request a copy of the personal information we have on you. You may contact us if you wish to request this information.

Section 8: Linked Sites. There may be a number of links on our Website to third party Websites which may be of interest to you. We are not accountable for any quality of the Goods or Services provided by such third parties nor do we have any control over the content or arrangement of such sites should you wish to transact with them.

Section 9: Complaints We take complaints in a very serious manner, and aim to respond to your complaints within 7 working days. All complaints should be addressed to the official contact information provided in this website.

Section 10: Limitation of Liability

10.1. Due Diligence has been taken to ensure that the information available on this Website is correct and error free. Our apologies for any errors or omissions that may have occurred. It cannot be warranted at all times that the use of the Website will be free from any error or fit for purpose, timely, that defects shall be corrected, or that the site or the server shall make it available without viruses or bugs or represents the 100% functionality, accuracy, reliability of the Website, as well as no warranty is made whatsoever, whether express or implied, relating to fitness for purpose, or accuracy.

10.2. We shall not accept any liability for any delays, failures, errors or omissions or loss of transmitted information, viruses or other contamination or destructive properties transmitted to you or your computer system via our Website.

10.3. We shall not be liable for any failure or delay or condition of our provision of Goods & Services, where such failure arises as a result of any act or omission, which is outside our utmost reason and control such as inevitable events caused directly and exclusively by forces of nature that can be neither anticipated, nor controlled, nor prevented by the exercise of prudence, diligence, and care, including but not limited to: war, riot, civil commotion; compliance with any law or governmental order, rule, regulation or direction and acts of third parties.

10.6. We shall decide at our absolute discretion which orders to fulfill in cases we have to choose among orders in light of multiple different orders in the context of an Event of Force Majeure.

10.7. We sell products for direct and private consumption only. The Company does not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the Website or for any products or services purchased from us.

10.8. In spite of reasonable steps and due diligence, and there have been unlikely events of a security breach in our database, we cannot be held liable.

10.9. If we have reason to believe that there exists an abuse of vouchers and/or discount codes or in suspected instances of fraud, we may cause the client to be blocked immediately and reserve our right to refuse future service from such client. This does not exclude our claim to seek compensation or legal redress.

10.10.  Promotions and Offers are subject to our absolute discretion and may be withdrawn at any time and without notice, except for already confirmed Orders or Contracts.

Section 11: General

11.1. All prices are in Philippine Pesos. VAT is included where indicated.

11.2 We don't sell liquors for ages 18 & below as mandated by the law. We always verify the customer's eligibility on buying our products from our online and physical retail store.

11.3. We may subcontract any part or parts of the Services or Goods that we provide to you from time to time and our rights under these Terms and Conditions are assignable at our own discretion without your consent or notification to you.

11.4. We may change and revise the Terms and Conditions at any time without prior notice.

11.5. Payment must be made online upon ordering. Failure to pay checked out goods every 5:00 P.M. on a working day shall will result to the automatic cancellation of your order and non-reservation of any goods or service.

11.6. These Terms and Conditions and our Agreement shall be governed by the laws and judicial system of the Philippines.
